FORK Terms of Service

1. Introduction and Acceptance

Welcome to FORK, a creator marketplace for AI prompts available at forkitover.ai (the "Site" or the "Marketplace"). FORK is operated by FORK ([Legal Entity Name — to be confirmed]) ("FORK," "we," "us," or "our").

These Terms of Service (the "Terms") are a legal agreement between you and FORK. They govern your access to and use of the Marketplace, including buying credits, unlocking prompts, browsing the library, and — if you choose to become a creator — publishing prompts and earning payouts.

By creating an account, buying credits, unlocking a prompt, or otherwise using the Marketplace, you agree to these Terms. If you do not agree, please do not use FORK.

Some parts of FORK are covered by additional terms that work alongside this document: our Acceptable Use Policy (what is and isn't allowed on the platform), our Privacy Policy (how we handle your data), and — for people who publish prompts — the Creator Agreement. Where another policy applies, it is incorporated into these Terms by reference. If there is a direct conflict between these Terms and the Creator Agreement on a creator-specific topic, the Creator Agreement controls for that topic.

2. Eligibility

To use FORK, you must be at least 18 years old (or the age of majority where you live, if higher) and able to form a binding contract. The Marketplace is not directed to children, and we do not knowingly allow accounts for anyone under 18.

By using FORK you represent that:

• The information you give us is accurate and you will keep it up to date.
• You are not barred from using the Marketplace under the laws of your country or any applicable sanctions or export-control rules.
• If you use FORK on behalf of a company or other organization, you have the authority to accept these Terms for that organization, and "you" includes that organization.

We may decline to provide service, or close an account, where we reasonably believe an eligibility requirement is not met.

3. Your Account and Security

You'll need an account to buy credits, unlock prompts, or publish as a creator. You agree to provide accurate sign-up information and to keep your login credentials confidential.

You are responsible for everything that happens under your account, including unlocks and purchases, unless and until you tell us your account has been compromised. Please notify us promptly at support@forkitover.ai if you suspect unauthorized access.

A few account rules:

• One person, one account. Don't share an account or create multiple accounts to evade limits, bans, or pricing rules.
• Keep your contact details current so we can reach you about purchases, payouts, security, and changes to these Terms.
• We may use reasonable security measures — including device signals, rate limits, and human-verification challenges — to protect accounts and content. Don't try to defeat or interfere with these.

You can close your account at any time by contacting support@forkitover.ai. Closing an account does not by itself entitle you to a refund of credits (see Section 4) and does not erase records we're required to keep for legal, tax, or accounting reasons.

4. Credits and Purchases

FORK runs on credits. Credits are the in-platform unit you use to unlock prompts. One (1) credit has a face value of US$0.10. Credits are a prepaid balance for use on FORK — they are not money, not a deposit, not a bank or stored-value account, and they earn no interest.

How credits work:

• You buy credits in bundles through our payment processor, Stripe. Available bundles, prices, and any bonus credits are shown at checkout and may change over time.
• You spend credits to unlock prompts. The credit cost of a prompt is shown before you confirm an unlock. When you confirm, the credits are deducted from your balance.
• An unlock is permanent for your account. Once you unlock a prompt, you keep access to it under the license described in Section 6 — you don't pay again to view it.
• Credits and unlocks are tied to your account. They are not transferable to another user and have no cash value except as expressly described in these Terms.

Purchases and refunds. Because credits unlock digital content that is delivered immediately, all purchases of credits and all unlocks are final and non-refundable except where required by law or where we choose, in our discretion, to issue a refund or credit adjustment (for example, for a duplicate charge, a billing error, or content we remove). If you believe you were charged in error, contact us at support@forkitover.ai. You agree that we and Stripe may apply fraud and chargeback controls, and that abusive chargebacks may result in account suspension.

Taxes. Prices may not include applicable taxes. Where we are required to collect tax, it will be shown at checkout or added to your purchase. You are responsible for any taxes that apply to you that we don't collect.

Earnings vs. purchased credits. Credits you buy are for spending on the Marketplace and cannot be cashed out. Credits you earn as a creator are handled separately and may be paid out under Section 8. If your earnings balance falls below the payout minimum and you want options for it, contact us at support@forkitover.ai.

5. Using the Marketplace

FORK gives you access to a library of AI prompts and related content created by FORK, by featured creators, and by the wider community. You may browse listings, unlock prompts with credits, and use unlocked prompts as described in Section 6.

Locked previews. Before you unlock a prompt, you'll see a limited preview. Previews are deliberately partial — they show you enough to decide whether a prompt is worth your credits, but they do not reveal the full working prompt. Trying to reconstruct, reveal, or extract the hidden parts of a locked prompt without unlocking it is not permitted (see Section 7).

Sample output. Some items in the library include example results labeled "Sample output." That content is AI-generated and provided to demonstrate what a prompt can do. It is illustrative only. We don't guarantee that you'll get the same or similar results, and sample output is not advice of any kind.

Availability and changes. We may add, change, reorganize, or remove content, features, pricing tiers, and parts of the Marketplace at any time. Because content can be created by many people, we can't promise that any particular prompt will remain available — for example, a creator may unpublish a prompt, or we may remove content in response to a complaint or policy violation. If a prompt you've unlocked is later removed, your access to it may end; where that happens because we removed the content (rather than because you violated these Terms), we'll consider a fair credit adjustment.

Service reliability. We work to keep FORK available and dependable, but the Marketplace is provided on an "as is" and "as available" basis (see Section 9). Maintenance, updates, and events outside our control may cause downtime.

6. Your License to Unlocked Prompts

When you unlock a prompt, FORK grants you a personal, worldwide, non-exclusive, non-transferable, non-sublicensable license to use that prompt and its included materials for your own purposes — including your own commercial work product — subject to these Terms and to any specific license terms shown on the prompt's listing.

What you may do:

• Use the prompt with AI tools to produce your own outputs.
• Use those outputs in your own projects and business, including commercially, unless the listing says otherwise.
• Adapt the prompt for your own use.

What you may not do:

• Resell, redistribute, sublicense, publish, or give away the prompt itself (or a lightly modified copy of it) as a standalone item, whether for free or for a fee, on or off FORK.
• Share the unlocked prompt text outside your account so that others can avoid unlocking it.
• Use the prompt to build a competing prompt library or to seed another marketplace.
• Remove, alter, or defeat any attribution, watermark, or content fingerprint embedded in the prompt or its materials.

Files included with a listing. Some listings include downloadable files (for example, a Claude Skill package, a custom GPT's instructions and knowledge files, or other agent artifacts). Your unlock lets you use and run those files for your own personal or internal business purposes. You may not redistribute, repackage, re-upload, or resell the files as a standalone product, on or off FORK. You must keep any license headers, notices, or attribution inside the files intact, and any third-party or open-source components included in a file remain governed by their own licenses. Files are provided "as is"; you are responsible for reviewing any code or file before you run or rely on it.

Content fingerprinting. Prompts and their materials may carry an embedded content fingerprint that ties the copy to your account. This helps creators and FORK detect leaks and unauthorized sharing. By unlocking a prompt you acknowledge this and agree not to tamper with it.

Ownership stays with the creator. Unlocking gives you a license to use the prompt — it does not transfer ownership. The underlying prompt and its intellectual property remain owned by the creator or other rights holder. Your license lasts as long as your account remains in good standing and the prompt remains available; it ends if you breach these Terms or if the content is removed.

7. Creator Content and Ownership

FORK is a marketplace, which means much of the content is user-generated. Creators publish prompts; buyers unlock them; and creators earn from unlocks plus "fork" royalties when others build on their work.

Creators keep ownership of what they publish, and they grant FORK the licenses needed to host, display, preview, fingerprint, market, and deliver their content, and to pay out their earnings. The full rules for publishing — including originality requirements, royalties, payouts, taxes, and takedowns — live in the separate Creator Agreement, which every creator accepts before publishing.

Originality and IP protection. FORK is built to protect creator intellectual property. An originality check is designed to block near-duplicate prompts at submission, locked previews never reveal the full prompt before purchase, and published prompts carry a content fingerprint. These measures reduce — but cannot completely eliminate — copying. We don't guarantee that every prompt is original or non-infringing, and we are not the author of community content.

Reporting a problem. If you believe content on FORK infringes your rights or violates our policies, contact us at support@forkitover.ai. For copyright complaints, we maintain a notice-and-takedown process; you can send a notice to our designated agent at [Designated Copyright Agent — name and address to be confirmed]. We may remove or disable content, and we'll handle repeat infringers under our policies. The detailed creator-side process is set out in the Creator Agreement.

Our own materials. The FORK name, logo, Site design, software, and any content we create (other than community content) belong to FORK or our licensors and are protected by intellectual property laws. These Terms don't give you any rights in our brand or technology beyond using the Marketplace as intended.

8. Fees, Earnings, and Payouts

Buying credits. You pay for credit bundles through Stripe at the prices shown at checkout. We may change bundle pricing and contents from time to time; changes don't affect credits you've already bought.

Creator earnings. When a buyer unlocks a prompt, the creator earns 70% of that unlock's value. Creators also earn "fork" royalties when other creators build on their prompt and those derivative prompts are unlocked. Earnings accrue continuously to the creator's balance as unlocks happen.

Payouts. Creator payouts are made on a weekly basis through Stripe Connect, and cover earnings only — credits you purchased cannot be withdrawn. To receive payouts, a creator must complete Stripe Connect onboarding, including identity verification and connecting a bank account. A payout requires a minimum earnings balance of US$10 (100 credits). If your earnings balance is below the minimum and you'd like to discuss options, contact us at support@forkitover.ai.

Processor terms. Payments in and payouts out are handled by Stripe, and your use of those features is also subject to Stripe's terms. We are not responsible for delays, holds, or errors caused by a payment processor, your bank, or incomplete onboarding or verification.

Taxes on earnings. Creators are responsible for their own taxes on payouts and for providing any tax information we or Stripe are required to collect. The full payout, royalty, and tax details are in the Creator Agreement.

9. Prohibited Conduct

You agree to use FORK lawfully and fairly. The full list of dos and don'ts is in our Acceptable Use Policy, which is part of these Terms. At a minimum, you agree not to:

• Scrape, crawl, harvest, or bulk-download prompts or other content, or use bots or automation to access the Marketplace in ways we haven't authorized.
• Try to view, reconstruct, or extract the hidden parts of a locked prompt without unlocking it.
• Resell, redistribute, or publish prompts in violation of the license in Section 6.
• Remove, alter, or defeat watermarks, content fingerprints, attribution, rate limits, human-verification challenges, or other protective measures.
• Upload, publish, or share content that is illegal, infringing, deceptive, malicious, or that violates the Acceptable Use Policy.
• Submit prompts that aren't original, that duplicate others' work, or that are designed to evade the originality check.
• Interfere with the Site's operation or security, probe for vulnerabilities, or introduce malware.
• Commit fraud, abuse refunds or chargebacks, launder funds, or misuse the credits or payout systems.
• Use FORK to develop or seed a competing prompt marketplace or library.

Violating this section may lead to content removal, loss of access to unlocked content, forfeiture of earnings tied to the violation, suspension, or termination, and may be reported to authorities where appropriate.

10. Disclaimers

FORK and all content on it are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement.

Specifically, we do not warrant that:

• Prompts will produce any particular result, output, accuracy, or quality. AI outputs vary, and "Sample output" is illustrative only.
• The Marketplace will be uninterrupted, error-free, secure, or free of harmful components.
• Community content is accurate, original, non-infringing, or fit for your purposes.

Not professional advice. Prompts, sample outputs, and other content are tools and information, not professional advice. If a prompt relates to legal, medical, financial, or other regulated subjects, you should rely on a qualified professional, not on FORK content. You are responsible for how you use any prompt and any output you generate.

Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you. In that case, our warranties are limited to the minimum extent the law requires.

11. Limitation of Liability

To the fullest extent permitted by law, FORK and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of the Marketplace — even if we've been advised that such damages were possible.

To the fullest extent permitted by law, our total liability to you for all claims relating to the Marketplace, in the aggregate, will not exceed the greater of (a) the total amounts you paid to FORK in the three (3) months before the event giving rise to the claim, or (b) US$100.

These limits apply to all claims and theories of liability — contract, tort (including negligence), warranty, statute, or otherwise — and form an essential basis of the bargain between you and FORK. Some jurisdictions don't allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless FORK and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Marketplace.
• Content you submit, publish, or share (including prompts and any claim that they infringe or violate someone's rights).
• Your violation of these Terms, the Acceptable Use Policy, the Creator Agreement, or any law.
• Your violation of any third party's rights.

We may take over the exclusive defense of any matter subject to indemnification by you, at your expense, and you agree to cooperate. You won't settle any matter that affects FORK without our prior written consent.

13. Suspension and Termination

You may stop using FORK and close your account at any time by contacting support@forkitover.ai.

We may suspend or terminate your access, remove content, or limit features — with or without notice — if we reasonably believe you have violated these Terms or our policies, created risk or legal exposure for FORK or others, engaged in fraud or abuse, or where we're required to by law.

What happens on termination:

• Your right to access the Marketplace ends, including access to unlocked prompts.
• Purchased credits are generally non-refundable (see Section 4); where we terminate without cause, we'll consider a fair adjustment for unused purchased credits.
• Where termination is for your violation of these Terms, earnings tied to the violation may be withheld or forfeited as described in the Creator Agreement.
• Sections that by their nature should survive — including ownership, licenses you've granted, disclaimers, limitation of liability, indemnification, and governing law — continue to apply after termination.

14. Changes to These Terms

We may update these Terms from time to time — for example, as the Marketplace evolves or the law changes. When we make a material change, we'll take reasonable steps to let you know, such as posting the updated Terms with a new "Last updated" date and, where appropriate, notifying you in the app or by email.

Changes take effect when posted unless we say otherwise. By continuing to use FORK after an update takes effect, you accept the revised Terms. If you don't agree to a change, your option is to stop using the Marketplace and close your account.

15. Governing Law and Dispute Resolution

These Terms are governed by [Governing law — to be set by counsel, e.g., the State of ___, USA], without regard to its conflict-of-laws rules.

Let's try to resolve things informally first. If you have a dispute with us, please contact us at support@forkitover.ai so we can try to resolve it. Many issues can be settled quickly this way.

If we can't resolve a dispute informally, it will be handled in the courts or other forum located in [Venue / jurisdiction — to be set by counsel], and you and FORK consent to that jurisdiction and venue. To the extent any binding arbitration, class-action waiver, or jury-trial waiver is to apply, those provisions will be added here on the advice of counsel.

Nothing in this section limits any rights you have under mandatory consumer-protection laws in your place of residence that cannot be waived by agreement.

16. General

Entire agreement. These Terms, together with the Acceptable Use Policy, Privacy Policy, and (for creators) the Creator Agreement, are the entire agreement between you and FORK about the Marketplace and replace any prior understandings on that subject.

Severability. If any part of these Terms is found unenforceable, the rest stays in effect, and the unenforceable part will be limited or removed to the smallest extent necessary.

No waiver. If we don't enforce a provision right away, that's not a waiver of our right to enforce it later.

Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.

No agency. These Terms don't create any partnership, employment, or agency relationship between you and FORK; creators are independent and not employees of FORK.

Force majeure. We're not liable for delays or failures caused by events beyond our reasonable control.
